1.1 These General Terms and Conditions (GTC) apply to all online offers and services available under the detoxi brand. These currently include:

1.2 These General Terms and Conditions also apply to areas for which you must register to use. If special terms and conditions apply to individual Services, these take precedence over the General Terms and Conditions in case of discrepancies.
1.3 A Service can generally be used on all platforms or devices supported by the provider. Restrictions, particularly technical ones, can be found in the respective service description.
1.4 If you access Services via an app and have downloaded the app from a third-party app store, the respective terms and conditions of use of that app store apply additionally. In case of conflicts, these terms and conditions take precedence.
1.5 When downloading and using Services, particularly in third-party networks or abroad, transmission costs from your internet access provider may be incurred.
The provider and your contractual partner for registrations, booking, and implementation of Services is detoxi Health GmbH, Schützallee 5, 14169 Berlin (hereinafter referred to as „Provider“ or „we“).
3.1 Some Services require a user account. By providing your email address and password and clicking the „Register now“ link, you initiate a binding request for a user account. A user agreement between you and the Provider is only established through electronic confirmation by the Provider. You will receive an email from the Provider with an activation link. Registration is complete upon clicking the activation link.
3.2 Alternatively, you have the option to register for some of our Services using your Apple, Facebook, or Google account. By clicking the corresponding button, you will be redirected to the third-party provider’s single sign-on. After activating the single sign-on, you will receive an email from the Provider with an activation link. Registration is complete upon clicking the activation link.
3.3 You are obligated to update your data if changes occur. You can also make other changes, particularly correction of typos, at any time in your profile. You are obligated to provide only truthful information about yourself (e.g., name, first name, insurance) for all questions.
3.4 Your user account is intended exclusively for your own private purposes. You may not transfer your access data to any third party. It is not permitted to transfer the booking to another person or to make content available to third parties. Please inform us immediately if you suspect unauthorized use of your user account.
3.5 Registration is only permitted from the age of 16 onwards.
3.6 If you select the „Stay logged in on this device“ function when logging in or save your login data in a web browser or other external program, there is a minor risk that third parties may gain access to your account.
3.7 If you have not logged out of your account and lock your device (e.g., laptop, computer, smartphone), the connection to our backend system remains active.
3.8 If you use a device with a so-called jailbreak or with root access, there is a risk that your data may be read by third parties.
3.9 You can delete your user account at any time. You can do this, for example, via your user account by clicking „Delete user account.“ The Provider also has the right to delete your user account if you have not actively used any Services or no longer have an active subscription for a period of three years.
4.1 Some services are subject to a fee. The provider makes available an overview of the available paid services, their prices, scope of services, and durations within the respective app and, where applicable, on detoxi.info.
Prices may vary by region and are displayed at the time of purchase in the app store. Price changes will be communicated in a timely manner.
4.2 The individual steps for purchasing paid services can be found in the descriptions within the third-party app store, the app, or the website detoxi.info.
By placing an order, you submit an offer. Merely clicking the order button does not yet constitute a purchase agreement for a paid service. Only after a successful payment process and the corresponding electronic confirmation is the order considered accepted and the purchase agreement concluded. Acceptance may also occur implicitly, in particular by activating the paid services.
4.3 In addition to paid subscriptions with various durations, the provider also offers the option to unlock services through a one-time payment. The duration of this activation is indicated in the offer description.
4.4 Fees are due in advance for the respective contract period. The payment methods shown in the offer description are accepted. The payment process is generally handled by corresponding service providers, which may in particular include the payment systems offered by the respective app store operators.
If the respective service provider includes its own general terms and conditions in individual cases, these apply exclusively to payment processing. Where applicable, the user must have a user account with the service provider.
4.5 The app store provider may influence the duration or renewal of, or the availability of, paid services. Depending on the app store, paid services may expire at the end of the agreed contract period without requiring cancellation, or the respective contract period may be extended indefinitely or for a corresponding period.
Details can be found in the terms and conditions or the respective offer description of the app store. The app store provides the option to terminate paid services via a corresponding menu item.
4.6 If fees cannot be collected and you are responsible for the cause, you shall bear all resulting costs. If payments are charged back or you have not paid fees, the provider is entitled to block access to all or individual services.
4.7 The provider may offer users paid services free of charge or at a reduced rate for a trial period. Which users may take advantage of this offer is at the sole discretion of the provider.
The provider may modify the scope of these offers and discontinue them at any time. The provider may require the user to provide payment details at the beginning of the trial period. After the trial period ends, the provider may charge the user the fees applicable for the continued paid use of the respective service. The user will be informed of this in the offer description and must agree to it.
If you do not cancel at least 24 hours before the end of the free trial period, the regular price will automatically be charged upon its expiry.
4.8 The provider reserves the right to change its business model at any time and, for example, to provide certain or all services only for a fee. The applicable fees will be published by the provider. The user is free to discontinue use or opt for the then-paid continued use.
4.9 Different age restrictions may apply to paid services. You will be expressly informed of the applicable age restrictions prior to purchasing a paid service.
5.1 The provider offers paid services with varying contract durations. Unless otherwise stated in the respective offer description, the usage agreement for the respective paid service initially runs for the booked minimum usage period.
You may cancel an existing contract at any time with a notice period of at least 24 hours before the end of the current subscription period. If no cancellation is made, the usage agreement will automatically renew for the duration of the booked minimum period. You may continue to use the services after cancellation until the end of the respective usage period.
5.2 Cancellation of the paid service, if the purchase was made through an app store, can be carried out as described in the respective app store’s subscription management section.
If the subscription was taken out via detoxi.info or another platform operated by the provider, cancellation must be submitted by email to info@detoxi.info. In the case of cancellation by the provider, notice will be sent to the email address you provided during registration.
5.3 The right to extraordinary termination for good cause remains unaffected. Good cause for the provider exists in particular if you violate applicable law or essential contractual obligations. Prior written warning is not required.
You have the right to withdraw from this contract within fourteen days without giving reasons. The withdrawal period is fourteen days from the day of contract conclusion.
To exercise your right of withdrawal, you must inform us (detoxi Health GmbH, Schützallee 5, 14169 Berlin, email address: info@detoxi.info) by means of a clear statement of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send notification of exercising the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (except for additional costs arising from your choice of a type of delivery other than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day we receive notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this refund.
If you have requested that the service begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of services already provided compared to the total scope of services provided for in the contract.

9.1 The Provider strives to offer all Services without interruptions as much as possible. However, downtimes may occur, particularly due to maintenance work, hacker attacks, or technical difficulties. Therefore, 24-hour availability of the Services is not part of the service.
9.2 The Provider also makes efforts to keep all information in the Services current and complete. However, some information comes from third parties or is changed at short notice. The Provider therefore does not guarantee the completeness, accuracy, or currentness of the information in the Services.
9.3 Use of all Services is at your own risk. The Provider’s liability is limited to intent and gross negligence. This does not apply insofar as main contractual obligations are violated. Main contractual obligations are those that the contract is specifically intended to grant you according to its sense and purpose, or whose fulfillment enables the proper execution of the contract at all and on whose compliance you may regularly rely.
9.4 In case of slight negligence, the Provider is also only liable for damages foreseeable at the time of contract conclusion and typical for the contract.
9.5 The aforementioned liability limitations do not apply to statutory guarantee liability, such as under the Product Liability Act. Furthermore, the Provider is fully liable for injury to life, limb, or health.
9.6 The Provider’s liability limitation also applies to the conduct and liability of its employees, legal representatives, and vicarious agents. The liability limitations also apply to all contractual and statutory claims, including tort claims, resulting from the use of a Service or the contract underlying these Terms and Conditions.
10.1 German law applies, as well as the mandatory legal provisions of your country, provided you are a consumer and reside in the EU / within the EEA. The place of jurisdiction is Berlin if you are a merchant or do not have a permanent residence in the Federal Republic of Germany, the EU, or the EEA.
10.2 Your user registration and the applicable Terms and Conditions, as well as your information during the order process, are stored by the Provider. The current version of the Terms and Conditions is available for retrieval at the URL https://detoxi.info/nutzungsbedingungen. The Provider also stores older versions of the Terms and Conditions. For your security, you should always save or print the current version.
10.3 The Services are only offered in German; contracts can also only be concluded in German.
10.4 Sometimes it may be necessary for the Provider to change these Terms and Conditions. This is the case when:
The Provider will always inform you 30 days before the new Terms and Conditions become valid about the change and give you the opportunity to terminate the usage relationship. If you do not terminate, the new Terms and Conditions apply after 30 days. The Provider will expressly point out this fact in the message about the changed Terms and Conditions.

10.6 The EU Commission’s platform for online dispute resolution can be accessed at the following link: http://ec.europa.eu/consumers/odr/. The Provider is not willing or obligated to participate in dispute resolution proceedings before an arbitration board with consumers. However, it will endeavor to resolve disputes out of court.
10.7 Should any provision of these GTC be or become invalid, this shall not affect the validity of the remaining clauses. In this case, the invalid or unenforceable provision shall be replaced by the parties with a valid provision that comes as close as possible to the economic purpose of the invalid or unenforceable provision. The same applies in case of a regulatory gap.
10.8 Only the German version of this site is legally binding for the contractual relationship. Translations are provided solely for better understanding and have no legal effect.
